Update: On how I closed this out (I am sure I was very very soft)

I sorted this out back in July17, and I would admit I played conservative.  She was just after her 2x rent which I took as deposit, and left the house as she had moved in.  But she had filed bankruptcy chapter #7, so that I don't pursue of her additional rent, expenses for change over, etc.  I had to just give her entire Deposit back :(, took the house tidy ready for the next tenant, and learnt my lesson.  Thanks for sharing your experiences.

Thanks Christine.  I think Termination Fee or remaining full amount of Lease would go first correct?  As in, Tenant should return that to me first?  And at time of Termination notice?

And for Deposit, it is based on move out inspection and within 45 days of Move out inspection as per State Law.  

Hello All - I am the Landlord of the Property.

I have a situation in Indianapolis, where the lease clearly states an Early Termination Fee and the Tenant seems to be making things up to not having to pay this.  Sounds like per Indiana Law, Security Deposit can not be deducted from Termination Fee.  

Any suggestions if you have experienced this before, on how can I have this settled?  I would look at the house at move out fairly and assess Security Deposit there, and return all dues back if no issues found.  But I also want to make sure I get Early Termination Fee back, since I will have some vacancy period, and will have to do all Tenant search all over again.

Appreciate any feedback on this!
