

YES!! Husbands and Wives can do IRA Investments Together
You might recall in a previous blog post I talked about the 3 rules to be aware of when using your self directed IRA to avoid the investment from becoming a disqualified transaction. If you recall, the #2 rule was "You cannot perform investments to disqualified people" and while that statement holds true there is a little wrinkle I need to share with you.
Just to recap, disqualified people include: your grandparents, parents, spouse, children, and children's spouse. Think of your linear family tree. Don't forget your CPA or attorney that makes decisions that affect your financial well being.
Now, to the wrinkle. The IRS rules do not say that you can go into an investment with a disqualified person, instead the rules govern that you cannot sell an investment to a disqualified person.
Let's break it down in an example. Mr. and Mrs. Jonca are interested in a land contract note that is worth $50,000 and is currently being sold for $35,000.00. Mr. Jonca has $20,000 available in his IRA and Mrs. Jonca has $15,000. Now, because they are GOING INTO the investment together they can pool their money to purchase the investment. As long as they do not SELL the investment to a disqualified person they have made an investment within the guidelines of the IRS.
