What do I do when a tenant disputes their claim on security deposit
I hear it ALL the time; that was like that when I moved in!!!! Ad nauseum… One thing I say over and over again; make sure that you have either taken photos, video or a thorough checklist prior to occupancy. AND make sure that what you are charging is legitimate.
Every state has their own landlord tenant laws, and it is extremely beneficial to become very familiar with them. For instance, in Florida, we must make our claim on the security deposit within 30 days of the tenant vacating if we intend to keep one penny of their money. If we intend to give back all of their money, that must be done within 15 days.
There are also laws regarding how you store their funds and notifying them of where it is kept, and does it earn interest.
One very important item to always remember; document, document, document…..If you ever need to go to court or provide evidence for anything it won’t be a problem.
Lastly, even if you have every note, every receipt, you could still end up in court. It’s most important for your peace of mind to try and resolve before you get to that point. Is it worth going to court over $150?
