If you are from a country that has a Treaty of Trade and Commerce with the United States, you may qualify to live and work in the United States as a treaty investor. First, you need to scale through the requirements. The process is a bit complex and can be stressful.
If your application is successful, you could potentially get to live in the U.S for an indefinite length of time.
Requirements for Qualifying as a Treaty Investor
- You must be a national of a treaty country. This is a country that has a Treaty of Trade and Commerce with the U.S.
- Your application must be based on your intention to start a business in the U.S or buy an already established one.
- You need to show that you have made substantial investment or that you are already making this investment in the business. Investments starting at $70,000 have been accepted for a restaurant business.
- You must have a control over the business. If you do not have control, you must be in a key executive or managerial role.
- Your investment must be capable of generating more than enough income to provide for you and your family. You can also show that it can create jobs locally and help the economy.
Duration of Stay in the United States
Once your application for the E-2 visa is successful, you will be able to stay in the U.S for up to five years. This period can be extended from time to time.
Additional Benefits
As a treaty investor with an E-2 visa, you can also bring in important employees. This can only apply where the employee is to render essential services to the business. The employee must be of the same home country as you.
Application Procedure
If you are already in the U.S and want to change your status to an E-2 visa, you can file your application with immigration. If you are in your home country, your application will be processed at the U.S consulate in your country.
