The Requirements For A Successful E 2 Visa Application

The E-2 investor visa is a visa category that allows people from certain countries stay in the US to manage their business. The countries this visa category applies to are countries that have a treaty of commerce and friendship with the United States.

The E-2 investor visa lasts for a period of two to five years. However, visa holders can renew it indefinitely. The E-2 visa status can be extended to the spouse and children of the applicant under 21 years. The spouse of a successful applicant can get a work permit to legally work in the US.

Requirements For The E-2 Visa

The following are some of the requirements that have to be fulfilled for a successful E-2 visa application.

  • The E-2 visa is only available to people from treaty countries. These are countries with a treaty of friendship and commerce with the United States.
  • The applicant needs to have substantial control of the company. This means that he should have more than a 50% stake in the company. He also needs to be in a managerial or other executive position in order to direct the affairs of the company.
  • The investment has to be a substantial investment. This means that the funds invested are adequate for the type of business in contemplation.
  • The returns from the business should not be marginal. Meaning that the returns have to be more than enough to take care of the investor and his family.
  • The applicant should intend to depart once the visa expires.
  • The enterprise has to be a real operating one. Not an investment that gives passive income like stocks, bonds, ETFs and so on.
