Deposit Stock in My Solo 401k Trust

QUESTION:

I own some personal stock in a publicly traded company that is held by a transfer agent. These shares are currently in my name registered in my name but I am paying a fee to have them registered in the name of my solo 401k trust account. So I am just now depositing this stock into my solo 401K trust account. What is the procedure for accomplishing this?

ANSWER:

Those shares cannot be deposited into a solo 401k plan. Only funds or assets held in an IRA or former employer plan can be transferred to a solo 401k plan not assets that you personally own. That would be a prohibited transaction. Specifically, such transaction would be in violation of the following prohibited transaction rule.
