7 Simple Things Sellers And Agents Can Do Right Now

(To Close On-Time And Smoother)!

 

Are you listing a probate home for sale?  Are you selling the home yourself as a “For Sale By Owner?”  Regardless of the situation, we all have the same goal in mind don’t we?  To close fast, to close with a simple process, to close without problems, and to net the most amount of money possible.

Let me share with you the 7 Simple Things You Can Do Right Now To Prevent Delays And Ensure A Smooth Closing:

 

  1. Establish rapport with the attorney. You are the real estate professional.  The attorney is looking for someone who can sell the property quickly, cooperate with the legal and other issues and close the transaction on time.  Exhibit those skills and you are taking the first step.  (But don’t forget to ask me how…there are some specific techniques that can be applied here, but more detail than I can go into here)
  2. Call your title representative right away for a free transaction review.  The title company is involved in reviewing and recording some of the legal documents that pertain to real property transfers by the estate.  Your title representative can help you avoid the “mine fields” in your transaction.  Be sure to work with someone who has ample experience in probate transactions.
  3. Obtain a copy of the letters testamentary or letters of administration.  You wouldn’t practice medicine until after you graduate medical school and pass the exams, would you?, You wouldn’t drive a car until you have a driver’s license, would you?  Likewise, you must have a signed copy of the letters issued by the judge prior to acting on behalf of the estate.  Prior to signing contracts.  Don’t put the cart before the horse!
  4. Review the process with the Personal Representative.  This is the person that will be acting on behalf of the estate.  Gather as much information from them as possible.  Often times they will provide you with much needed info.  You want to make sure everyone is on the same page and keep communication lines open with the representative.   5. Consult with the attorney on the case.  Again, make sure everyone is on the same page.  This is such an important step as the attorney can help guide you through the rough waters of the transaction.  Additionally, the attorney may inform you of information that the estate representative can't or won't give you.  You know the saying, you only get half of the story from each side.
  6. Ensure your escrow officer knows probate.  The escrow officer often touches every single piece of paper in a real estate transaction.  There are usually additional documents required as part of a probate transaction and it is important that your escrow officer is familiar with these documents and processes.
  7. Open your title order with a company/representative that specializes in probate.  If you have a foreign car you probably take it to a mechanic that works on foreign cars.  If you have a heart problem, you probably go to a cardiac specialist not an orthopedic surgeon.  Likewise, take your probate transaction to a title representative/company that specializes in probate.

I am sure that you want the sale of the house to go to escrow and close in a short time without any hang-ups.  In today’s market, that is not as easy as it once was!  The key is to assemble a team of specialists that cover all ends and prevent the glitches that sometimes come up.
