Got My First Letter from an Attorney Regarding TCPA from a Text Message

Wanted to share this with people as there is a correct way and an incorrect way to communicate. Many people will buy a list and start to email and text message those individuals. Did you know that fines can be $500+ for doing this? 

The proper way is to have someone opt-in to receive information from you. Whether it be from an ad, newsletter, whatever it is, and have them provide you with the information.

Why is this important? Because the fines can be upwards of $500/incident.

So what is my story, we have a fund where we have ads online. We had an individual click on the ad, and provide us with their name, email and cell phone number along with the notation that by submitting this information you agree to receive emails and text messages etc.

Well, I guess this person does not remember this (thankfully this is information we easily keep and have readily available), and had an attorney send us a letter noting their client never signed up to receive notices from us. A quick phone call to that attorney with providing the information we had on record resolved the issue.

But if you are buying names off of a list, be careful.
