Please I need some advices for my next project

I have a deal I'm about to get under contract my strategy is to fix and flip here's the situation this property has tenants but the agent told me they'll move out as soon as the deal is closed they want no contingency inspections my questions is what about if I get it under contract with no contingency inspections but in the process of buying this property the tenants decide to stay and not move out. can I still cancel the contract and get my EMD back? How can I fix this situation?
