bad contractor, property broken into, tools stolen what to do?
Hello Biggerpockets,
Not sure if this is the area this needs to go, if not let me know.
I hired a roofer and after 3 weeks of him not getting it done. I called him three days before hiring his replacement, didn’t get a call back. So I moved forward with the new contractor. I had to pay another roofer $2500 to finish out the job. And they got everything done in one day. He told me that I had until Dec 25th to pay him the money left on the contract, $800 or he would put a lean on the house. So Dec 25th comes around and the house is broken into and my other contractors that is rehabbing the inside , his tools are stolen and some sheet rock in the garage is damaged.
I had a simple safe alarm system, but it wasn’t placed on the internet so it didn’t automatically go off. (totally my fault) So the back sliding glass door is damaged, tools are stolen, sheet rock was damaged. It’s all a miss.
I’ve called the police and filled out the report and gave the police the bad roofers contact information. However, I don’t have any hard proof it was him. Now the bad roofer is calling me threating me, and saying he is going to place a lean on the house and he only wants $400 to finish out the contract. I’m in the middle of a refi on the property, so having a lean on it, could be a problem. The refi loan is in underwriting as I type this.
Am I responsible for my contractor’s tools?
Should I pay the bad roofer off to get him to go away. (I don’t want to reward bad behavior)
What else am I not seeing, that I need to know about?
