Help in RI For A First Time Homebuyer

Long story short.  I recently closed on my first home in RI through RI Housing first time homebuyer program.  The 2 family residence was sold fully occupied with tenants.  

I sent a timely termination letter to one of the tenants.  I am told by this tenant, "NO" & is intending to fight me in court.

Is this right for a month to month tenant to do?  I can't move into my home?

Any RI housing attorneys on this to give me some advice?

PLZ HELP!!!
