Water leak in bottom level condo.

Hi,

We closed on our first property a few weeks ago and are currently renovating it. We bought a condo and the unit above is leaking into one of our bedrooms. Our contractor thinks the leak has been going on for some time now because there is black mold on our drywall. The HOA in the community will not get involved in situations like these. They let the two owners resolve the issue.

The owner in the above unit is trying to find any reason for it not to be his issue.

Has anyone dealt with a situation similar to this one? Are we expected to pay for part of the repair? How would you handle this situation?
