Tenant moving out early

Hey Guys, have a newbie question. I have a rental property that the tenant signed a 1 year lease in August then called me and said they have to move in December cause the husband lost his job. So i worked out a deal and wrote up a Conditional Lease Termination Agreement. Over the phone we agreed to the terms and set a time to meet to get them to sign the lease term agreement. Well when i got over there they were not there and when I looked in the window it appears they have moved. Just some odds and ins left in the house. I have text messages stating they are moving. My question is how long before i can take back the house? Do I need to post anything for certain amount of time since i have txt messages stating they are moving today. On a second note i do plan on taking them to court for breaking the lease and for the "Stop Payment" they put on the money order for November's rent.
