Tenant vaping problem

I'm pretty sure when he spends the night he is vaping in the tenants room. I don't know a lot of people that vape, that can go 12 plus hrs without vaping.  It's in the rental agreement no vaping or smoking. I have already given her a reminder about it. 

I can't prove he is, she can't prove he's not. Should I ban him?
