Would you evict this person?

I came across this article today. The circumstances are a little unusual and I thought I would throw it out there for some discussion.

Sounds like this 80-year old has been staying in the apartment for 20 years. She has been undergoing cancer treatment and was in a care facility for six months. A caretaker who didn't live at the apartment was paying the rent. Apparently a couple of checks bounced.

Sounds like the caretaker tried to pay the bounced checks but the payments were not accepted.

After reading the story share your thoughts. Should the court allow this eviction? What do you think about the landlord's motivation?

It seems to me the landlord was less concerned about collecting rent than finding a way to get the tenant out. Getting the tenant out would allow the landlord to collect more in rents for the unit.

From what I can tell the landlord could care less if the tenant or tenant's caregiver paid all the rent and fees. The landlord almost got the eviction based originally on a misrepresentation of the facts. When the judge discovered there was more to the situation it is understandable that he called for further hearings on the matter.

There are lots of tough decisions to be made as a landlord, but I refuse to let greed be my primary motivation in doing business. In time the 80 year old will pass away or perhaps require a nursing home or otherwise move away. As long as the tenant pays the rent, I think the landlord and other landlords would be better served in waiting.

There is enough legislation coming down the pike rather than creating situations that may lead to more tenant friendly legislation that goes overboard.

You're right! My dog never bounces checks! However, if my dog was a deadbeat, he'd be out on his butt!

I'd bet you would evict your own grandmother too !

Bev, do you OWN any rentals at all, or do you just waste other people's money? Running a business has NOTHING to do with compassion for fellow human beings or respect for the elderly. Expecting the rent to be paid on time and in full does not mean the landlord is a money grubber. Where did you come up with this crap?

A landlord is in a BUSINESS relationship with his tenants. If the tenants don't pay, they can't stay - it's just that simple. When a tenant stiffs me for the rent, I consider that the same as someone STEALING FROM ME. I certainly do not have compassion for them and I don't have even the slightest bit of respect for them. Respect is earned, not bestowed!!! What I will do is GLADLY evict them as rapidly as the law will allow and I feel a LITTLE bit better when I throw their stuff out to the curb!
