Charcoal grill on small wood balcony ?

While inspecting the grounds of duplex in CA, I saw a charcoal grill on the second floor wood balcony. It's right next to the wood railing and probably less than 2 ft from the shingled siding.

The state regs. only address this issue for multi-family units larger than a duplex, so  I can't site state law to tenants.  I think it's too close to the house & will ask them to move it to the yard.

How would you approach adding an addendum to rental agreement?

Ditto what @Steve Babiak said and I would add vinyl fences. Wood fences too. Best to add a clause about BBQs and Cooking Grills to your property rules. Put it in an addendum.  

Also, if you don't do so already, require tenants to maintain Renter's Insurance.

Ask the fire marshal about their take on this. They may have educational materials that address this hazard. Educate your tenants and tell them they must move the grill to a safe location.
