Early Termination clause in Lease
Does anyone have a good example of an early termination lease clause for an Indiana lease in the case that we might want to sell the property, and is fair to both LL and Tenant?
What’s the end goal here? Do you want to be able to get the tenant out so you can sell to an owner occupied? Why make the lease tenant friendly to let them leave when they want?
You can always decide at a later time to let them out of their lease with an addendum you both sign. I’m sure some buyers might find an iron clad lease comforting.
@Mike Grable you could just have a month to month lease. Or make the lease renew every 6 months. There is no rule that you have to have a one year lease. You do take the risk that you will actually get a tenant that only wants the place for 6 months.
I agree with Colleen. Make the length of the lease shorter or do month to month.
I think it really depends on what your motive is here with the early termination clause. Either way, I would definitely recommend checking with your state's legal guidelines as well as getting legal council just to be sure you stay within both your's and the tenant's rights.
