Lease Extension Agreement Change - Can they do this?
Hi BP Community,
I need some advice/guidance...I own a STR that I've leased out to a corporate housing firm. It was leased until end of Nov. on behalf of their client. There is language about mtm after the lease has expired with a 30 day notice to vacate. They formally requested an extension until 1/31/22 which I agreed with. I was just informed yesterday that their client's work contract was terminated and now they are making them vacate and telling me that they are terminating the tenancy on 1/1/22 and referencing the mtm language in the lease agreement. My question is are they allowed to do that or should they be held to the amended term date of 1/31/22? The house is in Cook County suburbs of IL.

If there is a written, signed agreement stating they will stay until 1/31/2022, then that is what they are legally obligated to do. If the agreement to stay until 1/31/2022 was verbal, then the court would probably agree that they are under a month-to-month lease and can terminate with 30 days notice, since that's what the written agreement says.
