Lawyer messed up. Now what?

My tax lien lawyer didn't file the lawsuit within allowed time frame, and my tax lien expired. He apologized, said it's very unusual to have a case to fall through the cracks in his office, and promised to send me an amount to cover my investment and the interest I would have earned if held for all this time.

Now I was hoping for a foreclosure of this lien, in which case I'd potentially earn times more than the silly interest rate.

And BTW he has a few of other tax liens for me that are in the process of foreclosure.

What would you guys do?.....
