All Inclusive Trust Deed in California
Hey there BP peeps.
My wife and I are in the midst of negotiations on a property and the seller is open to creative financing. I've heard of doing an "All Inclusive Trust Deed," where where the seller retains their current mortgage and issues us a loan for the total purchase price. We pay the seller, they pay the bank - everybody's happy, everybody makes money... Hopefully.
Anyways my question is, as I've never done any sort of creative financing before (I am not a noob in real estate, just a noob in owner financing.) - Do I need an attorney to draw up an AITD? Does the Title Co handle it? Can I just google "AITD CA Promissory note" and use whatever form seems the most legit?
Any thoughts, advice, help, and recommendations are much appreciated.
