Sharif sale delay of confirmation

Paul Isaac
Posted

I purchased two houses at the sheriff’s sale at the beginning of the month. I was supposed to have a confirmation hearing for each today, but received a call last week from some attorney whom I don’t know telling me they were both canceled, they did not allow me to reschedule. Apparently it’s the virus crap. But I have no idea When the confirmation hearing(s) will be, no clue at all except for “at least a month”.

At this point, I would like to back out of the deal(s). I have been sitting on the capital without being able to make use of it waiting and waiting, I am done waiting. I really only want one of the two houses now, and would wait for that one, the other one I don’t even want anymore, because all of these delays have impacted my ability to fund the repairs.

I placed a ten percent deposit on each property, and would like that back from either one or both properties. I feel like this delay gives me cause to say the sale is invalid for failure to execute the deed(s) in a timely manner.

Should I call the court clerk, or the sheriff, to request repayment of my deposit? Do I even have grounds for such a request?

I still have no idea when the confirmation hearing is going to be, it has not been rescheduled, and with a backlog of court cases likely piling up, it may be many months. What am I supposed to do? I do not own any houses currently and have no amount of work to do, no houses means no income. I would really like some advice on how to proceed.

They have a significant sum of my money on deposit, as well I have my commitment to purchase, further tying up funds. I am not able to purchase any other house without using those funds, so I am stuck staying in this Airbnb shared with a guy who coughs all night long and doesn’t have a car, always bothering me for rides and rolling papers, ect, eating my food, and yesterday he was yelling and waving a large kitchen knife around threatening his “friend of twelve years” and scaring the crap out of me.

I am stuck in this crappy situation, and do not want to just wait it out, nor do I want to return to a hotel in Oklahoma City, 90% of the residents at such hotels are even worse than the current housemate. I need some help guys, any thoughts or advice at all? I really need to get another house to flip before I go broke without any income, and so I am here asking for some help. Does anyone know anything or have any ideas which could help to alleviate my dilemma? My choices right now seem to be walk away and lose the deposits or live with this a$$hole for an unknown amount of time without any income. I don’t like either option.
