Divorced couple - husband still occupies home!

I have a pre foreclosure I am trying to take over payments on. The wife is the only one listed on the mortgage but in NC it takes both husband and wife to sell. The wife is living in Washington state and has been my main contact through the transaction. She has agreed to let me take over her payments BUT the husband is still occupying the home refusing to make the payments. I have his contact info but have not contacted him yet. How do I get this guy out of the home with as little cash out of my pocket as possible? Any help is appreciated!

She may be the one listed on the loan ,BUT he could be on the deed  with her . If so you wont ever get him out .
