Buying my first property

Looking to purchase my first property! My seller is behind on there payments about 40k. If I pay the 40k to get them from underwater. Can they sign over the house to me or is it a bit more complicated than that? Also if they did do that would I be able to keep the payments with the same intrest rate that they had prior to signing over the house?
