property disclosure completely blank
Hi,
I am in the process of buying my first property (fourplex) in montana. I was provided with the seller's property disclosure form this morning. He left the entire thing blank, and signed his name on the bottom.
What I want to do is reject it, ask that he checks the boxes that don't allow a blank answer ("has knowledge" or "has no knowledge"), and write "N/A" or "no knowledge" on any line items that are only a write-in answer. He also did not check boxes for "airport affected area" (it is directly next to an airport) or "property leases, crop share agreements..." (leases w/ tenants are in place).
I know he has had some hefty repair bills in the past from looking at his cash flow statement; can I rightfully expect him to acknowledge those on the disclosure (even for things like "fixed running toilet")?
He did not occupy the property; the property management company ran it the entire time. Is it normal/accepted to have a property management company fill out a disclosure in the case of non-owner occupancy?
Please let me know if you have any advice on how to deal with this. I know my inspector will catch most things that could be wrong with the property, but I don't like the seller's dishonesty about blatantly obvious items.
