My wife and I are getting back into market again, and guess what her ex the "father" of my stepson. Was trying to tell me that owner financing was illegal and subject to was also illegal. The only thing that kept me from laughing in his face was his son was in the room. The only reason i didn't believe him was he was a Realtor for a few years and he lost his got fired and almost got thrown in jail for something screwed up. So could someone give me a run down on whats up with those two things!!!

Actually, I think its a pretty typical reaction to a few bad actors. Much of the legislation that's been put in place that limits various creative techniques, like the Colorado Foreclosure Protection Act, was a direct result of specific badly behaved investors. Even if most investors are fair in their owner financed deals, there's not doubt some of the same fraud and shaky practices that were used for conventional loans were used for seller financed deals.
