Buyer evicting tenants prior to closing escrow

Ken Buchanan
Posted

I have a triplex in California and prior to closing, someone shared all my tenants info with a property management company and they served an eviction on a tenant prior to closing escrow.

Whats my recourse to terminate or seek legal action against the buyers?

The buyer does not have legal authority to take action against the tenants until after they own the property. The Property Manager cannot work on behalf of the Buyer until the Buyer owns the property.

If you sold the property, why does it matter?

If you want to do something about it, report the Property Manager to the California Department of Real Estate and file a complaint: https://dre.ca.gov/consumers/f...
