However, I feel that if an investor is not willing to put this in, then they really should not be investing in real estate, and should consider investing in public markets or something else.

If you file a lawsuit and a lis pendens along with it, it puts the public on notice of your lawsuit and it will show up on any title report with a new buyer.A lis pendens makes it virtually impossible for a Seller to sell the house to a new buyer until they settle with you first.

It should not be any issue....a separate disclosure form to this fact would be advisable.There is some type of “notes” field when you input the data.....typically you can make certain notes visible only to other agents in your mls system, or you can make notes available to the public when they view it on Zillow, realtor.com, etc.I would include language about the title issue/circumstances in these notes, in the public section.
