By his/her signature herein below, Seller specifically agrees to the provision stated in this paragraph: (1) Buyer may cancel this Agreement, (2) Buyer may insist upon the specific performance of the Seller under this Agreement, or (3) Buyer shall be entitled to receive from Seller a total sum of $50,000 or 25 percent of the contractual price, whichever one is greater.

It takes a certain chutzpah to complain about people giving you numbers you don't like when you contact them, when they have not listed their property, and then further insist that they throw out the first number.

I once had a seller insisting that his home was worth 5% more then one just like it down the street  that sold the week before because his front door was red and the other home had a blue front door, and he was serious.

I was curious what one needs to be concerned about should the buyer or seller insist on this but since I haven't even used one of my own yet, I suppose I wouldn't have a preference anyway but did you still run the contract for the condo and the (almost) seller financed deal by your attorney or title company or in the case with the seller's lawyer, if they are closing a real estate transaction are they neutral in their involvement?
