Resolving a Distressed Title in NC - Carpenter vs. Longan Ruling
I found a property in pre-foreclosure and need advice on how to clear the title in this case.
Scenario:
The seller wants out for the cost of his second (renovation) loan. The primary lender sold the promissory note but kept the mortgage. The story is that the right team could invalidate the improper handling with a title forensic search and an attorney familiar with Carpenter vs. Longan (1857), which ruled that the promissory note and mortgage must remain tied together.
Who has experience with this in NC? I need advice on the probability of clearing the title and what it will take to do so.
