Stormwater Bill Landlord or tenant responsibility

My tenant decided to stay and sign another years lease. We (landlord) started getting a monthly bill in the middle of last year for this service. It is $4.70/month.  We have paid for it up until the new lease starts. Is it the responsibility of the landlord or tenant to pay monthly stormwater fee from state? If I put a statement in the new lease that tenant is responsible shouldn’t we be legal fine?

Still landlords responsibility for 

a) charging the wrong amount in rent 

b) for any bills from city/state/federal government not specified in the lease. Adding an addendum after an original lease is signed (per OP) is optional for the tenant. So hopefully landlord didn’t tell them they had to sign the addendum, that might not be legal. They could face a penalty way higher than $60 if the tenant complained to the governing authority. 

Ps. Why in the world would they charge “under market rents” AND go after the tenant for $5/mo? If rents are more than $5 under market rent just charge the correct rent. If rent control or increase caps are imposed while a lease in effect they will have locked in hundreds of dollars per month in losses for years.
