tenant has not paid rent for one month.. she has no plan how she will have fund to pay on time each month.

shall call the lawyer for eviction, right? In NJ, tenant will cover all count and lawyer fees for landlord?

The lawyer will process everything?

What if tenant pays the rent during eviction process?   do landlords still pay the attorney fees?

Call a lawyer now! Evictions can be a mess. I’ve been through two in NJ. There are a lot of ins and outs so I don’t want to misinform you with my  “non legal” advice but one wrong step in the process and you start over so seek legal council.

As for lawyers cost, it needs to be in your lease. However, the chances of you ever receiving that money is slim.

Just get that tenant out. The process can take about two months. Talk with your lawyer if you plan to accept any money from the tenant. I’m sure there are other BP members that can offer better legal advice than me but I think it’s safe for me to say that many will agree to start the process now! Good luck and I hope it goes smoothly for you.
