New York State Eviction

Hi Everyone, 

I owned a multi-family property in Broom county in NYS. One of the tenants stopped rent payment about 6 months ago and avoid contact with us. That particular tenant has some annoying behaviors bothers other tenants on the buildings. The property is managed by my property management company. I was planning to evict that tenant about 4 months ago. Under the newest NYS moratoriums, it prevents any kind of eviction during the pandemic. However, it states that tenants has to prove that they are COVID impacted to avoid the eviction, so I should still be able to prove the case that my tenant is not because of that. I wanted to establish the case, but my PM told me the reason we can't evict the tenant is because the court is not open. 

Just wondering in is anyone in BP is experiencing the same issue with me? Is my PM totally honest about this and what would be my next action here? Thank you!!
