Lead Disclosure- House built in 88
Good morning,
I am drafting my first lease, and had a question regarding the lead disclosure- it is a SFR that was built in 1988, so no lead paint. Do I still need to put the lead clause in the lease and give the pamphlet and disclosure, or am I covered because there is no lead paint in the house? Here is the wording of the cause as it is now:
Housing built before 1978 may contain lead-based paint. Lead from paint chips and dust can pose health hazards if not managed properly. Lead exposure is especially harmful to young children and pregnant women. Before renting pre-1978 housing, Landlords must disclose the presence of known lead-based paint and/or lead-based paint hazards in the dwelling. Residents have also received a federally approved pamphlet on lead poisoning prevention.
Landlord's Disclosure:
(1) Presence of lead-based paint and/or lead-based paint hazards.
(a) Landlord has no knowledge of lead-based paint and/or lead-based paint hazards in the housing.
(2) Records and reports available to the Landlord.
(a) Landlord has no reports or records pertaining to lead-based paint and/or lead-based paint hazards in the housing.
Resident's Acknowledgement:
(3) Resident has received copies of all information listed above.
(4) Resident has received the pamphlet 'Protect Your Family from Lead in Your Home'.
Certification of Accuracy
The parties have reviewed the information above and certify, to the best of their knowledge, that the information they have provided is true and accurate and to the best of Landlord s and Resident s knowledge no lead-based paint exists in or on the premises.
Is this completely unnecessary? The pipes in the house are poly-b, so no lead issue with that either. TIA
