Subdividing Property and Starting New Construction While Rented
I have a property in a rural area that is currently rented to a young couple. It is 1 acre, and I intend to subdivide the property, leaving about .6 acre with the current house and creating a new .4 acre parcel next to it. This is in WA state. Is there anything preventing me, from a lease/legal perspective from doing this? The lease is silent, except for perhaps one sentence that says," No right under the Lease may be waived except by written instrument executed by the party who is waiving that right.".
They may be fine with it, but I want to know where I stand before having the conversation. I'll likely offer them rent reduction for the duration of construction, but that's not the advice I'm looking for. I'd like to know if I'm legally able to do this, or what my options are for doing it. The value gained exceeds the rent many times over, so I want to be sensitive and accommodating, but in the end, I need to do this no matter what.
