Paint a red border around the garden and post giant "DANGER Keep Out" signs, then have the tenant sign a statement acknowledging they are aware of the potential danger.
People can and will sue for just about anything. Don't you watch Judge Judy?
If you are worried your tenants lack common sense, remove said plants. BTW, why is common sense so uncommon?!
