Question about Tenant Parking Rights

Erin McNamara
Posted

Hello! We are new to being landlords and we recently rented out a studio apartment that sits behind our house to our first tenant this fall. My question is that we had stated in the lease agreement that we would provide a parking space (rookey mistake), the parking space is actually curbside parking in front of our house which we make a point to not park in and to leave it available for our tenant.  In our driveway we have room for 2 vehicles side by side, or possibly 4 if you stack them one behind the other.  Our tenant is concerned about getting blocked in by the snow plows that plow our streets in the winter.  She is now insisting that she get to use one of our driveway parking spaces (because our lease states that we would provide a parking space, even though it was clear when she signed the lease that we were referring to parking on the street), which will mean that there will always be one car blocked in in the driveway.  She is also asking to plug her truck into our outside outlet (on our house, not her rental unit) at night.

My questions are -

Her rent includes utilities, but does that mean we have to cover her truck plug-in as well?

Is revising the lease allowed at this point (to specify that we do not provide a parking space)?  Or do we just need to own up to our mistake and give her half of our driveway? This is a month-month rental, btw and I don't actually want to lose this tenant but I am just not sure how well we would all manage having to share our driveway with her.

Thanks for any input!
