Tenant is not paying the rent after lease expired

Hello

I have a situation where my tenant is not paying rent after lease expired and saying that he will evacuate the house in next few days but there are no sign of him leaving.

What is the best strategy for me at this moment?This is a single family home in Elmhurst IL.

Right now, seriously, right this very minute - issue that free loader a Notice To Quit Due To Non-Payment of Rent.  Since you're out of state, email it to him and let him know that the eviction process has commenced and then send it by certified mail with proof of delivery requested just to seal the deal.  (In Illinois, failure of tenant to vacate at termination of lease is a reason for eviction along with failure to pay or to pay on time).  It's amazing how some people just need a little motivation in order to do the right thing...this - along with keeping his security deposit - should pretty much do it.  You got his Syed...
