Tenant wants to babysit
Hello
I have a SFR that is currently marketed for rent. A good, qualified tenant (family) has turned in an application to move in February, of all months. Previous landlords have provided good references as well.
The wife / mother has babysitted in the past for friends and family members. She has stated that she intends to continue babysitting. This will not be a licensed daycare, that's for sure, but I'm concerned about the liability.
Seems like a good tenant, but is there a way I can protect myself if she keeps babysitting while renting from me?
The property is a 2 story, newer model (2006) home with no playground equipment, lead based paint, etc.

Interesting question. I plan to follow this topic.
On the one hand, if she had 5-6 kids of her own, you wouldn't be giving this a second thought, apart from the added wear and tear on the property.
But, they aren't her kids. And if something goes horribly wrong -- and look out below if it's something that can in any way be attributed to the property -- you can bet you're going to get sued.
I'd see if your liability insurance would cover this, for starters.
You also should look into whether she needs a license to run this business. If you knowingly allow her to run an unlicensed business, you could be setting yourself up. (I'm sure your standard lease says that running a business from the house is not permitted, correct?)
