Property Management issue
I listed a home with a property management company here in Oklahoma and everything went great right up until the time that the renters actually moved in. The house had sat vacant for a while and had a list of smallish maintenance items that needed to be addressed. The tenants put down a 4500 dollar deposit and a 500 dollar pet deposit. Paid a prorated half months rent and a full months rent of 3600. Soooo we are up to the management company having 10,400.00 of the tenants monies. During the first half month the management company really starts dropping the ball....scheduling appointments to fix things then not showing up with proper equipment or not showing up at all, repairing things incorrectly, making unnecessary repairs, breaking more than they fix. I get on the phone with them as well as email and explain that they need to step it up and that its getting annoying for the tenant and myself. The initial list of 12 honey do items has gone down to about 10 over a three week period. At that point in time I explain to them if its not completed in the next 10 days they will be fired. We'll 10 days comes and goes and the list does go down to about 8 items left. They explain to me that the items will take 3 weeks to arrive. It is at this point that I fire them.....go to the local home depot and fix 7 of the 8 items the next day. There was a 1 month wait on a specialty item. I also hire a plumber and electrician to redo work that they had done because it was performed incorrectly. I told them they could keep there initial fee and that I would pay for the work that they performed correctly.... this amounts to about 3400 bucks. Here's the kicker....they refuse to give me or the tenant the deposit or rent back. Is there something unethical going on here? Seems pretty shady to me. I have a lawyer involved and we are going after them but are there any other options that I have?
