Cession of Lease
Hi there,
I have searched Biggerpockets.com and the internet for the answer, but to no avail.
Would anyone have a document already drawn up that I could amend for the cession of a lease. My tenants have moved out of the apartment and gave me the 20 business day notice that they were breaking the lease which in South Africa is compliant with the Consumer Protection Act, and I have no problems with.
I am just searching for a document that allows for the written proof that a full handover has been done with regards to the state of the apartment and that the keys have been handed back and to nullify the balance of their lease?

I have a document that I created called "Return of Possession". Here is the text from that document, specific to Washington State, you may borrow some ideas from it and/or modify it for your own use. If you print it on company letterhead, then your name, address, phone, and/or email address will be on the document it. Or add such to the text.
RETURN OF POSSESSION
Tenant: ____________________________________________________________
Rental Unit Address: _________________________________________________
The tenant returned possession of the premises (as stated above) to the landlord on the date of ____________________ and attests that they have returned ALL sets of keys to the landlord.
The tenant attests they have removed from the property all personal belongings. If anything was left by the tenant and later found, it shall be stored and/or disposed of by the landlord as per law.
Security Deposit: As per the rental agreement and as required by law (RCW 59.18.280) within fourteen (14) days after the termination of the rental agreement and vacation of the premises, or the landlord’s learning that the property has been abandoned, the landlord shall mail to the tenant’s last known address a full and specific statement of the basis for retaining any of the deposit together with the payment of the refund due the tenant under the terms and conditions of the rental agreement. The tenant paid a security deposit of ___________, which will be considered for this purpose.
