Difficult tenant .....need advice please
I rent out a beautiful luxury apartment in a co-op for 2,250 per month. After maintenance, mortgage and rental fee my costs are about 1,750 per month. So I make about $500 monthly on the place. The apt was gut renovated shortly before the tenant moved in. Everything new. It’s one of the nicest apartments in one of the nicest buildings in the entire neighborhood. The tenant seems very wealthy but I don’t exactly know her finances since I screwed up right from the beginning and the day she brought her financials we signed the lease and she handed the co-op board the copies but then refused to give me a copy. She said it was not necessary as the board got the info. There was no arguing after her “fait accompli”. Anyhow, things were ok for the first two years but when the pandemic hit she said she asked for a $200 discount on the rent. I told her I hardly made anything as it is but I gave in. The next year I wanted to end the discount. She said first she wanted several luxury upgrades. I told her no but she implied if I did not give in she would stop paying rent and it would take me forever to get her out. As the courts were closed I felt I had to give in to this blackmail but said she could choose either the upgrades or the continuation of the discount. She chose to continue the discount. The lease is coming due again and while I would prefer a different tenant, and don’t want to sell, it is very difficult to find a new rental as the board has enormous fees and conditions for a renter to be approved. So I notified the tenant by certified mail three months before the lease is up that because of the 8% increase in my own maintenance I am only willing to renew at the original rental amount. Of course she wrote back that I never did the upgrades and there are all sorts of problems with the apt and I can only legally raise the rent 3% etc etc. I wrote back I can rent at any amount I want and despite my increased costs I would give in once again and give a discount but this time only $50 off the original rent. And that while I will do repairs luxury upgrades would have to come out of the several thousands of dollars in savings I gave her. I also wrote that I needed an answer in thirty days as if she was moving I needed that time to prepare for the vacancy. So now 45 days have past and while she paid last months rent she refuses to answer me on her intentions to renew or move. No response to email or phone calls. I am so frustrated by this that I am seriously considering rescinding the offer but I’m unsure this is legal for me to do so at this late date.
