Title Company mis-sent funds to wrong person 😳

My title company in NWI has two files of mine and mistakenly sent two draws to the wrong person. The person they sent the money to already spent it and says they will pay it back but keeps missing the deadline. The title company is dragging their feet on getting the money back and this is hurting me in getting my bills paid. There is still money left in the escrow account to pay bills but the Title company says they need to prepare a document that relieves the title company of responsibility for their mistake first before they unfreeze the file.. Any help would be appreciated. Thank you
