Do you still buy a rental that has secondary egress issue?

Looking to close on a deal that we just found out has 2 bedrooms in the basement and 1 has no secondary egress. Numbers look good - 24% ROI and $400/mo cash flow. What are the liability issues of having a non conforming bedroom? Section 8 tenant is already in place and section 8 has approved the house as a 4 bedroom. Would you still go forward with the deal?
