Urgent: Oil tank removal holding back closing

Hi I am purchasing a property in New Jersey and there is a big issue with the oil tank and the seller does not want to pay to fix it and my lawyer says that there's no clause in the contract that they will be responsible for it, my question is can I pull out of the contract? or is my lawyer right that as long as they didn't put an anything about it I am responsible for it and I must close and take the loss???
