In the state of NJ can one member of the LLC sign the listing agreement or does all members have to sign if it is not dictated in the operating agreement? This is for putting a property on the market to sell.
The Operating Agreement of the LLC (if one exists) would state whether members can act independently to bind the company.
I believe a real estate agent could reasonably rely on the authority of one member to sign a listing agreement and bind the company. The execution of a deed would require more investigation. If no OA existed, the title company would require an LLC certificate identifying all members and signed by all members, plus all members would need to sign the deed unless one member was specifically authorized by resolution to do so.
