Wording for a Two Bedroom House

I'm hoping to find an answer on wording that is ethically allowed for listing specifics on a house.

I have an offer on a house that is listed as a two-bedroom in San Luis Obispo County. Upon doing my due diligence, I found that the house has been tagged for the second bedroom, which was originally a garage, and was done without permits. It will take about $25K to bring it up to code. Is the listing agent allowed to advertise the property as a two-bedroom?
