Bird Dogging?

I realize this question may open a can of worms, but I can't seem to find a definitive answer. I've searched here and google several different ways.
But, does anyone here know if bird dogging is legal in Massachusetts?

We look at "Bird Dogging" as subcontracting out our marketing. Is it really any different than paying a marketing company or call center for leads?

This also leads to a good referral network.
