Bird Dogging?

Question

I realize this question may open a can of worms, but I can't seem to find a definitive answer. I've searched here and google several different ways.
But, does anyone here know if bird dogging is legal in Massachusetts?

We look at "Bird Dogging" as subcontracting out our marketing.  Is it really any different than paying a marketing company or call center for leads?

This also leads to a good referral network.

It is gray in any state. If all they are doing is marketing and not negotiating you will be better off. :mrgreen:

Regarding "...who is going to report you...", I guess you can ask Miriam in the Bigger Pockets Post I referenced above.

It's all in your state's definition, your actions, and a REC or AG ability to enforce. If you are "just birddogging" you are probably fine. Just don't interface with licensed brokers when in NC, since that is explicitly not allowed.

You can simply can your state real estate commission board and ask them to be safe, but to be honest about the matter who is going to report you for bird dogging?  Do you think a seller will report you if you for helping them out of a mess and do you think a buyer will report you if they make a glob of cash?

It really depends on what your term of "birddog" means and exactly what you are doing relative to your state's definition.

Don't know your state so call your state department of real estate and ask if finders fees are permitted in your state. Try and get your answer from someone with standing not a clerk that started last week. Or just write and ask and get your response in writing. Most states allow.

This is a fee strictly for, and only for the introduction of one party to another so do not add any other required duties to the task.

If for some reason if it is not done just become a principal in your buyers deal and let them buy you out for a predetermined amount.
