For  little more input you should draw a lay out of the Basement showing the entrance way, the door to the outside, The outline  should show measurments and  size of the kitchen area.

Yes you are in a landlord tenant agreement by proxy.If you do seek homeowners you need to tell them of your situation and find out from them what they want done or what they will cover in this case.The best course of action in my opinion was outlined for you above.So here it is - this is not legal advice.

We always give them a report outlining what has been with held and why so there is no issue later.In case the cost of the repairs exceeds the deposit amount you can ask the tenant to pay.

I am not sure of the details of your contract but It seems like your landlord might have violated Idaho State law by not explicitly stating end date of the contract on the lease and also not specifying termination process.Here is the Idaho State Attorney document outlining these terms.The document also outlines your rights as a tenanthttp://www.ag.idaho.gov/publications/consumer/LandlordTenant.pdfI would recomend sharing this document with you landlord to help justify your reason for terminating contract.

Both work for me, I just have better control and up front knowledge the deal will happen with the wrappable financing rather than the uncertainty of whether a new investor will buy into the program as outlined, after I have already sold the property and created the note.
