So, my take is that you are legally out your EM (though as Dion pointed out, you can try to fight it and might win).

But gun fights and blood stains definitely count as "property damage" I don't want.

If you are lucky, that will solve the problem, but most likely, because the cheapest fix possible was used, you can expect the same song and dance with another fix on the same thing a couple months later.This will be very problematic if you have a tenant in place, because they probably won’t want to be without hot water that long, and scheduling the vendors will also be complicated.They are also really good at fighting even legitimate claims.

Sure, it is easier to win the war if you win more battles, but some get so concerned they are fighting battles, they forget about the war.  

If you don't have to fight the weather to go to work then who cares?

If not, and they are trying to get you on a technicality, be prepared to hire an attorney and fight it (and share the gory details here!).

Hi Everyone, I had 2 tenant (boyfriend & girlfriend) in my duplex.They had/have a couple violations (noise/fighting, smoking) they have cause damage to the unit.One of them (the boyfriend) decided to break the lease and move out in May. 

A colleague referred me to a realtor down that way; I called and left a VM about a week ago and nope no return call...so I'm not going to fight to give them business.I am looking for either a home for my family for the long haul, or a temporary home for us to move to, then wait for the right home, and rent the temp digs.

Naturally I'm more than willing to pay the security deposit back just to get past this and move on with my life, as this is not really worth fighting over, however the attorney is asking $1,500 in legal fees so the total amount they're willing to settle without going to court is just below $3,000.
