I've discovered ceiling stains and some tenants informed me of small ceiling leaks from the bottom unit.

I don't know about the permitting process in CA but I would assume (depending on the type of permits), the inspector would need access to the pipes or electrical components. 

This way it's not a surprise that is discovered after closing because the seller lied.

You have discovered the key problem with new construction. 

One of the reasons why the seller would not want a structural inspection is that if something is discovered and you forward that information to them, they will have a duty to disclose to all future buyers.
